2、第136条规定为基点，着重探讨由此而生的不动产权利登记的有关问题。文章首先介绍了国内关于“土地空间权”的各类观点，认为土地空间权利作为一束权利，并不能独立于传统物权体系。文章总结了国内各层级法规及规范性文件的规定和实践做法，并借鉴美、日、德及台湾等国家和地区的法律规范以及海外学者的研究成果。针对我国土地空间利用所涉不动产权利登记中的问题，认为土地空间分层利用的不动产登记应当纳入现有不动产登记制度体系，应区分不同的开发利用形态和权利类型确定登记范围，并建议引入立体宗地和共有宗地概念，登记中应淡化公（共）用面积的分摊，逐步建立
