2、ialcircumstancethatthemurderoccurredwhiledefendantwasengagedinthecommissionofalewdandlasciviousactuponaminor.Inaseparateproceedingheldaftertheguiltyverdictwasrenderedbutbeforethepenaltyphasebegan,thejuryfounddefendantcompetenttostandtrial.Defendantpurportedtoapp
3、ealfromthecompetencedetermination.WhilethatappealwaspendingintheCourtofAppeal,apenaltytrialwasheld.Thejurysentenceddefendanttodeath,andthetrialcourtdeniedtheautomaticmotiontomodifytheverdict.Thedeathjudgmentwasautomaticallyappealedtothiscourt.Theinterlocutoryapp
4、ealfromthecompetencedeterminationwastransferredhereandconsolidatedwiththeautomaticappeal.Forreasonswhichwillbeexplained,theinterlocutoryappealfromthecompetencedeterminationwillbedismissed.Wefindnoprejudicialerroraffectingtheguilt,competence,orpenaltyverdicts.The
5、judgmentwillbeaffirmedinitsentirety.A.ProsecutionCaseOnFebruary15,1983,thevictim,12-year-oldLashan,andherparents,DarrellandSallyK.,movedfromPacificatoDalyCity.TheirnewhomewastheMissionBellMotel,whichwasoccupiedprimarilybypermanentresidents,includingfamilies.Darr
