2、PhilosophyunderthesupervisionofProfessorLiWeiChongqing,P.R.ChinaMay2017摘要分析法学诞生于19世纪初期的西方,它的形成源自实证主义这一哲学思潮对法学领域的渗透。因为坚持实证主义的基本立场,分析法学是拒斥形而上学的,它希望将对法律的研究局限在“实在法”的范围以内,从而使法学成为一门科学。分析法学的代表人物有奥斯丁、凯尔森、哈特等人,他们的学说有一些共同的前提,如坚持法律与道德相分离。但是,他们的学说亦有差异,他们在实证主义的基础上,又各自吸收了不同的哲学思
3、想,如新康德主义、逻辑实证主义等,这使得他们的学说表现出了不同的理论侧重,并在“法律的本质”等核心问题上发生了分歧,并由此产生了不同的分析法学流派。本文将通过分析奥斯丁、凯尔森、哈特为代表的三种分析法学学说,以弄清分析法学的思想基础和形成过程,了解其主要内容以及共同点、差异点,并以此考察哲学思潮是怎样进入其他科学领域并发生重要作用的。本文分为三个部分:第一部分探讨分析法学的哲学渊源;第二部分探讨三个分析法学流派的形成和主要内容;第三部分比较三个分析法学流派的异同。关键词:法哲学;实证主义;分析法学中图分类号:B505IAb

5、peofpositivelawandmakejurisprudenceascience.RepresentativepersonagesofanalyticaljurisprudenceincludeAustin,KelsenandHart.Theirtheorieshavesomecommongrounds,suchasadheringtotheseparationoflawandmorality.However,Theirtheoriesaredifferentinmanyaspects;theyrespectivel
6、ytakedifferentphilosophicalthoughtsastheirownpremises,suchasNeo-Kantianism,LogicPositivism,etc.,andthismakestheirtheoriesdifferintheoreticalemphasis,disagreeoversomeessentialquestionssuchasthenatureoflaw,andasaresult,differentschoolsofanalyticaljurisprudencearise.
7、Inthisarticle,wewillanalyzethreeschoolsofanalyticaljurisprudence—Austin,KelsenandHart,toprobeintotheirthoughtfoundationsandformingprocesses,tograsptheirmainstandpoints,andtheirsimilaritiesanddifferences,andmaybethisanalysiscanalsoshowhowaphilosophicthoughtdoesexer
