AIROPERATORCERTIFICATEAPPLICATIONFORMINITIALISSUE/VARIATIONOFANAIROPERATORCERTIFICATE(AOC)Notesapplicabletotheapplicationforinitialissue/variationofanAOC(IncludingthePartMSubpartGApproval).1.Thisapplication,ifforaninitialissueofanAOC,mustbesubmittedatleast90dayspriortothedateoftheintendedstartofoperations.TheOperationsManualmustbesubmittedatleast60daysbeforetheintendedstartofoperations,togetherwithadetailedStatementofComplianceandtheproposedscheduleofeventsforgrantofanAOC.2.Theoperator’scertificateshallremainvalidsubjectto:·TheoperatorremainingincompliancewiththerelevantrequirementsofRegulation(EC)No216/2008anditsImplementingRules,takingintoaccounttheprovisionsrelatedtothehandlingoffindingsasspecifiedunderORO.GEN.150;·TMCADbeinggrantedaccesstotheoperatorasdefinedinORO.GEN.140todeterminecontinuedcompliancewiththerelevantrequirementsofRegulation(EC)No216/2008anditsImplementingRules;and·Thecertificatenotbeingsurrenderedorrevoked.UponrevocationorsurrenderthecertificateshallbereturnedtoTMCADwithoutdelay.3.TheapplicationforavariationofanAOCmustbesubmittedatleast30daysbeforethedateofintendedchanges.Inthecaseofaplannedchangeofanominatedperson,avariationshallbefiledatleast10daysbeforethedateofproposedchange.AllvariationsmustbesupportedwiththerelevantOperationsManual(oramendmentsto)andotherdocuments(MaintenanceSupportContract,ContinuingAirworthinessManagementExposition,AircraftMaintenanceProgramme,AircraftTechnicalLogSystem,etc,etc)pertainingtothevariation.4.TheintervalbetweenapplicationandgrantorvariationofacertificatewilldependprimarilyuponmatterswithinthecontroloftheoperatorandnoundertakingcanbegiventhatTMCADwillbeinapositiontoreachadecisionwithinaparticularperiod.Nevertheless,ifafteraperiodof12monthstheapplicationprocesshasnotbeensubstantiallyprogressed,TMCADmayrefusetheapplication.5.Afeeamountingto25%oftheAOCfeemustaccompanyaninitialapplication.Thisfeecannotberefundedintheeventthatanapplicationisrefusedorwithdrawn.6.Afterinitialstudyoftheapplicationandattachments,TMCADwillscheduleaformalapplicationmeetingtodiscusstheproposedoperation.NOTESINRELATIONTOPARTI,SECTIONAOFTHISAPPLICATION:7.AcoveringlettermustbesubmittedwiththeAOCvariationoutlininganychangeswhicharebeingappliedforandiftheapplicationisbeingsubmittedwithoutallsupportingdocumentation,thelettershouldincludetheexpecteddatesofsubmissionforeachofthemissingdocuments.8.Nameofcompanyshouldbetheregisterednameofthecompany(thelegalentity)seekinganAOC,notthenameofintendedaircraftoperation.9.Addressshallbetheoperatingaddressofthecompanytowhichallcorrespondenceshouldbesentandshallberegisteredonalllegaldocuments.10.ForapplicationstovarytheAOC,thee-mailaddress,telephonenumberandfaxnumbermustmatchwhatisonyourexistingAOCunlessyouareapplyingtovarythesedetails.Also,the“contactdetailsatwhichoperationalmanagementcanbecontactedwithoutunduedelay”shouldmatchthedetailsonyourexistingoperationsspecificationsunlessyouareamendingthese.11.ThecontactmobilenumberandpersoninthissectionshouldbethepersonwithwhomCADwillcommunicateregardingthisapplication.NOTESINRELATIONTOPARTI,SECTIONCOFTHISAPPLICATION:12.NominatedPersonsCV’sshouldbeattached,orsentseparately.ToNominatetheContinuingAirworthinessManager,EASAform4shouldalsobesubmitted.AllCV’sshouldbeaccompaniedbycopiesofrelevantlicences,endorsementsandcertificates.FormTM/CAD/0068Issue6–August2016TransportMaltaistheAuthorityforTransportinMaltasetupbyACTXVof2009Page12of12
