2、事诉讼法》不仅将“尊重和保障人权”条款写入，还对非法证据排除所涉及的实体性问题和适用程序，作出了较明确、具体的规定。这标志着非法证据排除规则在我国正式在立法层面得以确立，对于完善我国刑事诉讼证据制度、规范侦查人员的取证行为、保障被告人的合法权利、防止冤错案件的发生、推进司法文明有着重大意义。但非法证据排除规则毕竟是我国新引进的刑事诉讼制度，结合当前立法和司法的现状，非法证据排除规则在司法实践操作中尚存在一定的难题，易出现不统一和偏差。非法证据排除规则在司法实践中是否能够得到有效的落实，关系到我国刑事侦查、检察和司法部门的职责和公民个人权利的保障。鉴于此，本文详

3、细研究并解释非法证据排除规则的基本概念和应用难点。结合司法实践，通过阐述公检法三机关与新确立的非法证据排除规则之间关系，详细分析了目前我国侦查机关、检察机关和司法审判机关在运用非法证据排除规则的现实状况，剖析了适用过程中公检法三机关所面临的障碍，提出了相应的解决路径。本人试图通过以上方法对非法证据排除规则深入研究，以期更准确地理解和适用该规则，以便提高其在司法实践中的操作性和实效性。关键词刑事诉讼非法证据排除规则侦查检察审判IAbstractAbstractTheCriminalProceduralLawnotonlywritesthe“respectandp
