1、中文摘要薄某某受贿、贪污、滥用职权一案的公开、公正审理具有不可磨灭的法制意义。它在关键证人出庭作证、证人拒绝出庭作证等环节均严格遵循新《刑事诉讼法》之规定。论文分五章，以薄某某受贿、贪污、滥用职权一案作为切入点，先介绍近亲属拒证制度的概念，将本案探讨的近亲属范围限定在配偶、父母和子女这三类亲属范围内，并阐明确立近亲属拒证制度的合理性；然后从历史角度分析我国古代封建立法中的“亲亲相隐”制度，同时指出了现有的法律体系中却缺乏这一制度的原因和现状；接着从比较视野下指出大陆法系国家和英美法系国家所确立的近亲属拒证权制度的异同点；最后在总结国内外先进经验的基础
